Presidential immunity is not all-encompassing.
The Supreme Court issued their final opinions for the 2019-2020 term on Thursday ahead of the Court’s summer recess. The cases of McGirt v. Oklahoma, Sharp v. Murphy, Trump v. Vance and Trump v. Mazars were decided on.
McGirt v. Oklahoma, which was linked by the court with Sharp v. Murphy had the court voting 5-4 determining that a Creek Nation reservation would continue to belong to the tribal government. The specifics of the case does not allow the state government of Oklahoma to have jurisdiction over the Creek Nation.
The case of Trump v. Cance was linked with Trump v. Mazars and brought up questions of the separation of powers and the extent of presidential immunity from legal proceedings while in office.
In a 7-2 decision, the court determined that the president is not immune to his financial documents being subpoenaed. The case is returning to the lower court where President Trump may still argue that complying with such a subpoena would interfere with the ability to do his job.
